IP Europe welcomes the US government’s decision on SEPs
BRUSSELS – On 8 June 2022, the US government announced its decision not to issue the December 2021 Draft Policy Statement on Licensing Negotiations and Remedies for Standards-Essential Patents Subject to Voluntary F/RAND Commitments or any similar new statement.
IP Europe warmly welcomes this development. Our chair Collette Rawson commented: “we support yesterday’s decision by the US government. IP Europe submitted public comments highlighting the shortcomings of the 2021 draft. We also support the clarification that an earlier imbalanced 2013 Statement will not be reinstated.”
She further added that “the decision recognises that the current legal regime promotes technological innovation and consumer choice, and enables industry competitiveness – including in emerging technologies. Moreover, it acknowledges that the current regime fosters market entry of new and small-to-medium sized entities whose participation in the standards ecosystem is key to promoting innovation and job creation.”
